Legal Definitions in the State of Kansas
Statutory rape is defined as sexual acts with individuals under 16 years of age, which are illegal regardless of the age of the defendant.
Unlawful sexual act refers to any of the following offenses: rape, indecent liberties with a child, aggravated indecent liberties with a child, criminal sodomy, aggravated criminal sodomy, lewd and lascivious behavior, sexual battery, or aggravated sexual battery.
Rape is defined as sexual intercourse with a person who does not consent to the act.
Sexual battery is defined as the intentional touching of another person, who is 16 years of age or older, not the offender’s spouse, and who does not consent to the touching, when done with the intent to arouse or satisfy the sexual desires of the offender or another person.
Aggravated sexual battery is defined as the intentional touching of another person, who is 16 years of age or older and does not consent to the touching, with the intent to arouse or satisfy the sexual desires of the offender or another, under any of the following circumstances:

When the victim is overcome by force or fear;

When the victim is unconscious or physically powerless;

When the victim is incapable of giving consent due to mental deficiency or disease; or
-
When the victim is incapable of giving consent due to the influence of alcohol, narcotics, drugs, or any other substance, and this condition was known or reasonably apparent to the offender.
Stalking is defined as the intentional harassment of another person that places that person in reasonable fear for their safety.
Harassment is defined as a knowing and intentional course of conduct directed at a specific individual that seriously alarms, annoys, torments, or terrorizes the person and serves no legitimate purpose.
Domestic violence is defined as an act or threatened act of violence against a person with whom the offender is or has been in a dating relationship, or an act or threatened act of violence against a family or household member by another family or household member. It also includes any other crime or municipal ordinance violation against a person or property, when directed toward someone with whom the offender is or has been in a dating relationship, or toward a family or household member.
